Why the Forces Help to Buy application status doesn't mean your legal is done

Receiving your Personal Identification Number (PIN) from the MOD is a major milestone, but it doesn't automatically trigger the legal transfer of funds. To avoid delays, your lawyer must submit a formal Claim Form to the MOD at least two weeks before completion—a window that often clashes with the fast-paced nature of modern property chains. If your lawyer doesn't understand the specific sequence of the FHTB loan agreement versus the standard mortgage deed, you risk missing your moving date or, worse, losing the loan entirely for that specific window.

The gap between MOD approval and lawyer readiness

Many serving personnel believe that once the MOD approves the FHTB application, the money is 'ready.' It isn't. The MOD doesn't just send the cash to your bank account; they send it to your lawyer's client account, and only after a specific set of criteria are met.

We often see a 'hurry up and wait' scenario. You've done the hard work on the JPA system, got your commander's sign-off, and received your PIN. However, a lawyer cannot legally request those funds until they have a signed Mortgage Deed from you and a confirmed exchange of contracts in sight. If the legal side hasn't progressed to the point of 'Reporting on Title' to your main mortgage lender, that FHTB money stays with the MOD.

Understanding the FHTB Timeline vs. Standard Conveyancing

Standard residential conveyancing follows a predictable path: offer, survey, searches, enquiries, exchange, and completion. When you add Forces Help to Buy into the mix, a second parallel timeline is created.

Why 'Soldiering On' with a local lawyer can backfire

It’s tempting to use the lawyer recommended by the estate agent or the one in the town where you’re currently posted. But property law is national, and military law is specialized. A lawyer in Leeds might be excellent at local house sales, but if they haven't seen an FHTB Undertaking in six months, they won't know that the MOD's requirements for 'Evidence of Insurance' are stricter than a standard lender.

I’ve spent 20 years managing these exact pressures. Being the spouse of an Army veteran means I don't just see a file; I see a family trying to time a move between deployments or school terms. We ensure the FHTB Claim Form is submitted the moment the chain is solid, rather than waiting for the day of exchange when it’s often too late to meet the MOD's processing window.

Three things to check with your lawyer today

If you're currently in the middle of a purchase, don't wait for your lawyer to call you. Ask these three questions to ensure your military loan is on track:

  1. "Have you received the FHTB Loan Agreement from me/the MOD?" - Sometimes these get buried in email attachments.

  2. "Does my main mortgage lender have any restrictive conditions regarding the FHTB second charge?" - Your lawyer needs to clear this early.

  3. "Are we on track to submit the MOD Claim Form at least 10 days before our target completion date?" - This is the 'red line' for military moves.

FAQ: Common FHTB Legal Hurdles

Can I use the FHTB loan for a Buy-to-Let property?

No. The scheme is strictly for properties you intend to occupy as your primary residence. If your lawyer discovers during the process that you intend to let the property out immediately, they are legally bound to inform both the MOD and your mortgage lender, which will result in the loan being withdrawn.

What happens to the FHTB loan if I leave the service unexpectedly?

This is a legal point often missed. The loan is usually repayable in full upon leaving the service, though there are 'terminal benefits' offsets. Your lawyer should explain the 'Instruction to Pay' which ensures that if the house is sold, the MOD gets their money back before you see the profit.

Does the FHTB money go to me or the lawyer?

It goes directly to the lawyer's client account. You will never see the cash in your own bank account. This is why the link between your legal team and the MOD's payment office is the most critical part of the entire transaction.
