Resolving Complex Title Issues on a Multi-Million Pound Purchase

In another case, Joanne acted on a multi-million pound property purchase that initially appeared to be a lost cause. The transaction had previously fallen through, with the property deemed unmortgageable due to unresolved access issues.

Joanne provided clear advice from the outset, explaining that resolving the issue would require detailed investigation with no guarantee of success. She carried out an in-depth review of the title documentation, extending beyond the property itself to include surrounding land.

Through meticulous research, Joanne uncovered a historic right of way dating back to the early 1600s that had been long overlooked. What followed was extensive investigative work and correspondence to formally reinstate and secure the right of way.

Her persistence paid off—the access issue was resolved, the property became mortgageable, and the transaction completed successfully. Both the buyers and sellers were delighted with the outcome, with the sellers even sending a personal thank-you gift in appreciation of Joanne’s efforts

Achieving a Smooth and Timely Leasehold Sale Despite Complex Issues

Joanne acted for a seller who was working to a tight deadline due to an onward purchase, with increasing pressure as delays began to arise within the chain. The transaction was further complicated by the property being leasehold, with a defective lease and a missing landlord—issues that can often cause significant delays or even prevent a sale from proceeding.

From the outset, Joanne took a proactive and strategic approach. She carefully reviewed the lease documentation, identified the defects, and advised on the most appropriate course of action to enable the sale to proceed. Despite the absence of a landlord, Joanne explored all available legal options and worked to find a practical solution.

She ensured that all documentation was prepared as early as possible and maintained consistent communication with the buyer’s solicitors and estate agents to manage expectations and keep the transaction progressing. When additional enquiries arose as a result of the lease issues, Joanne dealt with them promptly and thoroughly, minimising disruption to the chain.

Through persistence, clear communication, and a solutions-focused approach, Joanne was able to overcome the complexities, allowing the sale to complete successfully within the required timeframe. This enabled the client to proceed with their onward purchase, avoiding further stress and uncertainty.
